Vanuatu Tourism Office (VTO) “Twelve Days of Christmas” Competition 2024

TERMS & CONDITIONS

Information on how to enter forms part of the terms and conditions of entry. By
submitting an entry, all entrants are deemed to have accepted these terms and
conditions.
The “Promoter” is Vanuatu Tourism Office (VTO), Ground Floor, Tamarama
Building, Lini Highway, Po Box 209, Port Vila, Vanuatu
The game of skill promotion commences 7:00AM (Vanuatu time) Sunday 1 st
December 2024 and concludes at 6.00PM (Vanuatu time) Thursday 12 th December
2024. (“Promotional Period”). Entering the promotion constitutes acceptance of these
conditions.
The promotion is only open to Eligible Entrants.
An "Eligible Entrant" is an individual who is:
- Not an employee, officer, servant or contractor of the Promoter or any
  organisation associated with the Competition or provision of the gift/prize, or
  their related corporate bodies or associates or any of their agencies involved
  with the promotion.
- Not a spouse, de facto spouse, parent, child or sibling (whether natural or by
  adoption) of such an employee or other person as described in clause 5(a)
  above.
- Aged 18 years or over.
- Open to participants worldwide
- Participants who enter via Story Sharing must have a public Instagram
  account to enter.
All relevant instructions on the Promoter’s website (if any) form part of these
conditions.
To enter the promotion, participants must complete the following “Entry
Requirements”:
- Follow @VanuatuIslands on Instagram.
- Like the daily giveaway post to enter that day’s giveaway.
- No restrictions on entering each day’s giveaways, participants can enter
  every day.
- Complete any specific entry requirements mentioned in the daily post,
  such as tagging friends, sharing on your stories, answering questions etc

All entries become the property of the Promoter.
By entering the promotion, participants consent to the Promoter using the entrant’s
Instagram handle (via Direct Message) or Facebook account (via Messenger) to
contact them if they are the winner.
By entering the promotion and claiming the Prize, the Winner agrees that the
Promoter may use their name and Instagram handle for publicity and competition
purposes without compensation and agrees that the Promoter will own copyright.
This competition is a game of skill. Chance plays no part in determining the winners.
All entries will be judged individually on their merits based on originality and
creativity.
Each daily prize will be announced in the giveaway post. Which will be scheduled for
6am Vanuatu Time and boosted to our global audience.
- Each giveaway post will also be shared on the @vanuatuislands Instagram
  story.
- Each daily prize will close at 7pm Vanuatu Time with the winner announced
  before 8pm Vanuatu Time on @vanuatuislands story.
- Prizes may include local Vanuatu accommodation, products, experiences, or
  travel vouchers. Flights to and from and within Vanuatu are not included and
  are at the expense of the prize winner, all additional accommodation,
  personal expenses, meals and travel insurance are not included in the prize.
- Prizes are non-transferable, non-exchangeable, and cannot be redeemed for
  cash.
Winner Selection and Notification
- Winners will be selected from qualified entries at 7pm (Vanuatu time) and
  announced on @vanuatuislands story.
- Winners will also be notified via a direct message on Instagram from
  @vanuatuIslands.
Claiming Prizes
- Winners may be required to provide proof of identity and eligibility to claim their prize.
- Vanuatu Islands reserves the right to arrange delivery or pick-up of prizes at
  its discretion, depending on the winner’s location.
The Promoter expressly disclaims any responsibility and entrants agree to indemnify
and hold harmless the promotion entities from and against any and all claims,
actions, demands and/or liability for injury, damage or loss whatsoever relating to or
arising in connection with participation in this promotion (regardless of the cause of
such injury, damage or loss) and/or the delivery and/or subsequent use or misuse of
any of the prizes awarded.
This promotion is in no way sponsored, endorsed, or administered by, or associated
with Instagram or Meta.
The Promoter reserves the right, at any time, to verify the validity of entries and
entrants (including an entrant’s identity, age and place of residence) and reserves the
right, in its sole discretion, to disqualify any individual who the Promoter has reason
to believe has breached any of these Terms and Conditions, tampered with the entry
process or engaged in any unlawful or other improper misconduct calculated to
jeopardise fair and proper conduct of the competition. Errors and omissions may be
accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its
rights at any stage does not constitute a waiver of those rights. The Promoter's legal
rights to recover damages or other compensation from such an offender are
reserved.
The Promoter’s decision concerning any aspect of this promotion is final and no
correspondence will be entered into.
The Promoter collects information about entrants, including names and contact
details that entrants provide when registering or using our services, as well as
information from data houses, social media services, affiliates, and other entities. The
Promoter collects and uses that information to provide you with our goods and
services, to promote and improve our goods and services, to provide opted-in
entrants with targeted advertising, for the purposes described in our Privacy Policy
and for any other purposes, described at the time of collection.

Prize inclusions
Eligible Entrants who satisfy the Entry Requirements will be eligible to win one of the
“Prizes” below that relates to their entry category: You will only be eligible for the
prize highlighted on the day you enter. All prizes are subject to availability and
booking details will be listed on the prize voucher.
- Day 1: Iririki Island Resort - 7-night stay in a Deluxe Spa Ocean View Room,
  including Daily Buffet breakfast. (valid to 21 Dec 2025 – Black-outs
  21/12/2024 – 15/01/2025 & all school holidays)
- o Day 2: Vanuatu Watersports - Snorkel trip for 4 people + Sunset Cruise for 4
  people (valid to 30 th June 2025)

- Day 4: Breakas Beach Resort - 3-night stay in a tropical garden fare including
  Daily continental breakfast (valid until 30/04/2025) + Tamanu Day Spa -
  Ritual Spa Package for 2 people (Valid until 31/03/2025)
- Day 5: Ramada Resort - 1-night stay at Ramada including breakfast + 2
  pizzas and a bucket of Tuskers at Banyan Beach Bar (Valid until 01/07/2025)
- Day 6: Nasama Resort/Groovy Banana - 5 Night stay in beach view studio
  apartment including daily hot breakfast for 2 people + Family Photo Shoot
  with Groovy Banana (valid until 1/12/2025 – Black-outs 12/12/2024 –
  31/01/2025, 04/04/2025 – 28/04/2025, 27/06/2025 – 21/07/2025, 19/09/2025
  – 13/10/2025) + Family Photo Shoot with Groovy Banana – (valid until
  31/12/2025 – Efate only)
- Day 7: Nakatumble – 3-night stay for up to 2 adults and 2 Kids, breakfast,
  lunch & dinner during your stay, Airport transfers, Champagne on Arrival and
  2 hours of massage. (Valid until 31/12/2025)
- Day 8: Mangoes Resort & Restaurant - 3-night stay including daily light
  breakfast (valid until 20/12/2025, must be over 18 years old)
- Day 9: Holiday Inn Resort - 3 separate prizes of 2-night stays including
  breakfast for 2 Adults & 2 Children (valid until 30/06/2025 – Blackouts
  01/02/2025 – 28/02/2025, 10/04/2025– 28/04/2025)
- Day 10: Sailing Vanuatu - Full Day Cruise for 2 people (valid until 22/05/2025)
- Day 11: Matevulu Lodge, Santo - 2-night stay including continental breakfast
  included + free use of kayaks (valid until 31/12/2025) + Turtle Bay Lodge,
  Santo - 2-night stay in Ocean View Lodge for 2 people (valid from 31/01/2025
  until 01/12/2025
- Day 12: Havannah Boat House & K2 Kitchen & Trees and Fishes - 5-night
  stay at Havannah Boat House + Private chef dinner for 2 people + lunch or
  dinner at Trees and Fishes Restaurant
The total prize pool is VUV1,500,000 (approx. AUD19,000)
Vanuatu Tourism Office reserves the right to substitute for any reason whatsoever a
prize (or portion thereof) of comparable or greater value, at their sole discretion. The
prize is awarded “as is” without warranty nor guarantee, subject to any written
directions from a regulatory authority. No Prize substitution or cash equivalent of
Prize will be awarded for any reason, including any force majeure event.
All other costs not included in the Prize are the responsibility of the winner, this could
include but not limited to flights, transfers, meals, personal costs and incidentals.
The prize winner agrees to absolve the Vanuatu Tourism Office from any liability that
may result from or is claimed to have resulted from participating in the competition or
from the acceptance or use of the prize.
Any cost associated with accessing the promotion website is the entrant’s
responsibility and is dependent on the Internet service provider used.
Any ancillary costs associated with the Prize are not included.
Entrants consent to the Promoter using the entrant's name, likeness, image and/or
voice in the event they are a winner (including photograph, film and/or recording of
the same) in any media for an unlimited period without remuneration for the purpose
of promoting this promotion (including any outcome), and promoting any products
manufactured, distributed and/or supplied by the Promoter and promotional partners.
If this promotion is interfered with in any way or is not capable of being conducted as
reasonably anticipated due to any reason beyond the reasonable control of the
Promoter, including but not limited to technical difficulties, unauthorised intervention
or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent
permitted by law (a) to disqualify any entrant; or (b) subject to any written directions
from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as
appropriate.
Any cost associated with accessing the promotional website or the Internet in relation
to this promotion is the entrant’s responsibility and is dependent on the Internet
service provider used.
Nothing in these Terms and Conditions limits, excludes or modifies or purports to
limit, exclude or modify the statutory consumer guarantees as provided under the
Competition and Consumer Act, as well as any other implied warranties under the
ASIC Act or similar consumer protection laws in the States and Territories of
Australia.
(“Non-Excludable Guarantees”). Except for any liability that cannot by law be
excluded, including the Non-Excludable Guarantees, the Promoter (including its
respective officers, employees and agents) excludes all liability (including
negligence), for any personal injury; or any loss or damage (including loss of
opportunity); whether direct, indirect, special or consequential, arising in any way out
of the promotion.
Except for any liability that cannot by law be excluded, including the Non-Excludable
Guarantees, the Promoter (including its respective officers, employees and agents) is
not responsible for and excludes all liability (including negligence), for any personal
injury; or any loss or damage (including loss of opportunity); whether direct, indirect,
special or consequential, arising in any way out of: (a) any technical difficulties or
equipment malfunction (whether or not under the Promoter’s control); (b) any theft,
unauthorized access or third party interference; (c) any entry or prize claim that is
late, lost, altered, damaged or misdirected (whether or not after their receipt by the
Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any
variation in the Prize value to that stated in these Terms and Conditions; (e) any tax
liability incurred by a winner or entrant; or (g) taking/use of the Prize (or part of the
Prize).
As a condition of accepting the Prize, the winner must sign any legal documentation
as and, in the form, required by the Promoter and/or prize suppliers in their absolute
discretion, including but not limited to a legal release and indemnity form.
The Promoter reserves the right to amend the terms and conditions listed at any time
without prior notice.
